This course introduces the principles that govern private law disputes involving an international component, from an Australian perspective. Due to technology and globalisation, private actors now regularly transact internationally, and hence face a range of potentially conflicting legal systems when disputes arise. Private international law responds in three key ways: 1. Jurisdiction, determining the appropriate forum for a dispute to be resolved in; 2. Choice of Law, determining the law to be applied the dispute; and, 3. Recognition and enforcement of foreign judgments and awards.
